HOW TO ENTER a. The Contest begins on December 12, 2008 at 8:00AM
and ends on August 31, 2009 at 8:00AM. Redback Tools may change the
dates and/or terms of the Contest without prior notice. Any
material changes will be posted on its website (
www.redbacktools.com). b. The
promotion is an enter-to-win contest by Redback Tools, Ltd.
("Redback Tools"). To enter the promotion you must enter online at
www.redbacktools.com. You
must enter your first name and last name, complete address, city,
state, zip code, home telephone number, complete on-line
questionnaire, photograph, and include valid email address in the
online entry form. All entries must be received by All entries must
be received by August 31, 2009 at 8:00AM. Redback Tools is not
responsible for entries not received due to difficulty accessing
the internet, service outage or delays, computer difficulties or
other technological glitches. Redback Tools also is not responsible
for telephone service outages, delays, busy signals, equipment
malfunctions and any other technological difficulties that may
prevent an individual from accessing the Internet. All entries
become the sole property of Redback Tools. Entries made by Internet
will be deemed made by the authorized account holder of the e-mail
address submitted at the time of entry. The authorized account
holder is deemed as the natural person who is assigned to an email
address by an Internet access provider, online service provider, or
other organization that is responsible for assigning e-mail
addresses or the domain associated with the submitted e-mail
address. Redback Tools may request proof that any potential winner
is the authorized account holder of the e-mail address associated
with any potential winning entry. c. Each photo submission must be
the original photograph of the person submitting the photo, and not
contain copyrighted materials or any other materials that may be
restricted, prohibited or outlawed by federal, state or local laws.
Each photo submission must be a picture of the contestant
submitting the entry and may not include any other people. Redback
Tools has the absolute discretion to disqualify an entry based on
its sole and exclusive judgment. Redback Tools, at its sole
discretion, reserves the right to disqualify any entry if such
entry contains illegal, indecent, lewd or otherwise offensive
material, or if such entry contains material deemed to be
unsuitable for public viewing at the sole discretion of Redback
Tools. Photo submissions that do not comply with these rules will
not be eligible for the competition. d. Contestants will be
required to accept the conditions of the electronic photo
submission release form, as set forth at
www.redbacktools.com, before
entering and uploading their photo. e. By participating in any
contests, entrants agree to be bound by the official rules and
regulations of the promotion. 2. ELIGIBILITY a. The Contest is open
to all women who are 18 years of age or older and who legally
reside in the United States. Employees of Redback Tools, Handsome
Handyman, The Job Shack, any participating sponsors, affiliates,
subsidiaries, affiliated advertising agencies, promotion partners,
their immediate families (defined as spouse, child, sibling,
parent, or grandparent) and those living in the same household are
NOT eligible to participate. b. By entering the promotion or
participating in any promotion or prize-related activity,
participants agree to release, discharge, and hold harmless Redback
Tools, its participating sponsors (including Handsome Handyman),
affiliates, subsidiaries and their respective officers, directors,
employees, representatives and agents from any injury loss or
damages of any kind that may arise out of participation in this
promotion or out of acceptance, use, misuse, or possession of
prizes. By participating, participants agree to use these Official
Rules and the decisions of the judges, which are final and binding
in all respects. This Contest is void where prohibited by law,
rule, or regulation. All federal, state, and local laws, rules, and
regulations apply. c. Contestants are required to provide truthful
information and Redback Tools will reject, delete and otherwise
disqualify any entry that it discovers to be false or fraudulent.
Redback Tools will disqualify any entry from individuals who do not
meet the eligibility requirements, and Redback Tools will also
delete any entry received from persons under the age of 18. b. The
promotion is an enter-to-win contest voted on by the Handsome
Handyman and “The Job Shack” members located at
www.redbacktools.com. To enter
the promotion you must enter online at
www.redbacktools.com. You must
enter your first name and last name, complete address, city, state,
zip code, home telephone number, complete on-line questionnaire,
photograph, and include valid email address in the online entry
form. 3. PRIZE a. One (1) prize will be awarded. The winner of the
Miss DIY '09 will receive the following: * The opportunity to
attend many Handsome Handyman promotional events, tours, including
television and radio appearances (Redback Tools will pay standard
travel and lodging expenses for such appearances). * A webpage on
www.redbacktools.com
created and maintained by Redback Tools featuring the winner as
Miss DIY. * A "Miss DIY" Redback tool belt and Miss DIY apparel
(Approximate Retail Value: $1,000). b. Winner is solely responsible
for all taxes, duties, or other costs that may be associated with
the winning of a prize. c. Redback Tools makes no warranties
regarding the safety, condition, or fitness of any prizes awarded,
and will not be responsible for any loss, damage or injury suffered
by a winner through the use of any awarded prize. d. All prizes are
awarded to the winner only. No substitutions or transfers of prizes
is permitted. e. The winner will be required to produce
identification satisfactory to the Redback Tools. The winner will
be required to sign an affidavit of eligibility and release,
including a publicity release, as prepared by Redback Tools prior
to receiving her prize. Anyone using fraudulent means to
participate and/or win the Contest will be disqualified. 4.
SELECTION AND NOTIFICATION OF WINNERS a. Ten (10) finalists will be
selected by Redback Tools on September 14, 2009 from all eligible
entries received by August 31, 2009 at 8:00AM. Redback Tools will
select the finalists based on criteria found in section 4c. b. The
ten (10) finalists will be announced on
www.redbacktools.com on September
14, 2009 at 8:00AM PST at which point finalist photos and answers
to questionnaire will be posted at
www.redbacktools.com. The top ten
(10) finalists will be notified by phone and e-mail on September
14, 2009. Finalists have until September 19, 2009 PST to respond to
verify their willingness to continue in the Contest and to comply
with all Contest rules. If a finalist does not respond before the
deadline, a substitute will be chosen at the discretion of Redback
Tools. c. Winner selection process: Redback Tools will judge the
ten (10) finalists based on appearance, personality, congeniality,
talent, experience with Do-It-Yourself (“DIY”) tasks and projects,
Job Shack member votes and votes submitted at
www.redbacktools.com. i.
Personality: Jake Tyson (aka the Handsome Handyman) will assess
each finalist’s personality based upon an interview conducted
either in person or over the telephone. ii. Congeniality: Jake
Tyson will assess how he is able to converse and interact with each
finalist. iii. Talent: At the time of entry, each finalist will
have specified a DIY talent they posses and will demonstrate. Each
finalist will be asked to submit a video on redbacktools.com
demonstrating her talent by August 31, 2009 at 8:00AM. Talent can
be any DIY specific skill offered by the entrant and will be judged
by employees of Redback Tools and Jake Tyson on the participant's
creativity, ability, execution, and entertainment value. iv. Job
Shack member votes and those submitted at
www.redbacktools.com will be used
solely as a guide to assist Redback Tools in making its final
decision. These votes will not affect the outcome of the selection
of final winner. Dates for online voting will be at November 12,
2008 6:00AM through August 31, 2009 at 8:00AM PST. Only one
Internet vote per person. v. Finalists’ talent/appearance will be
filmed and posted on
www.redbacktools.com as well as
other affiliated websites starting November 12, 2008. vi. The
winner, who will become “Miss DIY”, will be announced on September
19th. All finalists must be present at the coronation ceremony.
vii. One (1) winner will be selected pursuant to the terms of these
rules from all eligible entries received, on August 31, 2009 at
8:00AM. 5. CONDITIONS a. By participating in the Contest, the
winner or winners agree to have their name, voice, or likeness used
in any advertising or broadcasting material relating to this
Contest, Redback Tools or its related entities, without additional
financial or other compensation, and, where legal, to sign a
publicity release confirming such consent prior to acceptance of
the prize. b. The interpretation of these and all other rules
relating to contests or promotions sponsored by Redback Tools is
reserved exclusively to Redback Tools. Its decisions shall be
final. c. Redback Tools reserves the right to supplement or change
Contest rules at any time. The decisions of Redback Tools are
final. d. Redback Tools reserves the right, in its sole discretion,
to cancel or suspend the promotion should a virus, bug, computer or
other problem beyond the control of Redback Tools corrupt the
administration, security or proper execution of the Contest.
Redback Tools in its sole discretion, may award prizes to entries
received by alternate means. All Internet participants agree to be
bound by these rules. 6. INTERNET PRIVACY POLICY a. By use of this
website and by entering the Contest, you agree to the use of your
